Tier 4 Visa to Family Visa

Hello,

I am currently a student on a tier 4 visa (23 years old). I have been in the country since September of 2014 and with my partner since that time. We got engaged in May of 2017. We want to get married and for me to stay here on the family visa as a spouse/partner. I have been working at the same place for about 2 and half years, but as I am only aloud to work 20 hours a week my annual income is around $6 K a year. My fiancé has not long finished uni and held a part time job, but currently is unemployed. He has been placed on a grad job, which is due to start in September where he will make more then the minimum financial requirement as it is salaried. Unfortunately, my visa ends October 30th and we would like apply for a the spousal visa if possible but due to the fact that he will not have been earning the requirement for 6 months before will this be impossible? Would it be feasible to apply for the finance route instead and put of getting married until he has been in the job for 6 months? I would appreciate any insight or direction to somewhere to get help and answers. Thank you in advance.

Hiya

As far as i am aware, there is no way round the financial requirement, your sponsor has to have been earning 18,600 minimum for 1 year or more. and have proof that they can earn this

Its such a crappy rule, especially when you are a uni student when earning that amount is impossible as you cant hold down a full time job to earn that wage and study :(

The same minimum income applies for a fiance visa which must be shown at the time the application is submitted. You can only apply as a fiance from outside of the UK and your own income won't qualify.

I think i can add few bits here given the fact i was on tier 4 before i got married to british citizen. I got married in 2014. I wanted to apply for flr m in 2015 when my visa about to expire. But i couldnt. Coz of financial requirement. Well i had option to apply under other route.

What about you extending your tier 4 if possible. And wait until you and your partner meet the requirement. I think you can apply as a unmarried partner provided that you can prove you and hour partner are living together for more than 2 years.

The only easiest solution might be the saving route if you and/or partner have around £62500 from the last 6 months.
