ICT Dependent to ICT General

Post by DpkUK » Fri Mar 16, 2018 4:33 pm

Hello,

I have below query about ICT Dependent Visa and any advice is very much appreciated.

I am currently on ICT Long Term Visa here in London but project is completed now and I have been asked to move back to my home country this month end. My spouse is working in a firm as 'IT Programmer' on a dependent visa currently. Now the firm has sponsor license and is ready to sponsor for my wife.

1.Does cooling period apply for both of us, if so how many months ?
2. Do we need to go back to our home country (India) to get the visa process.
3. Can I come back as dependent on my spouse's Tier 2 General visa ?
4. Any other generic advice would be appreciated

Her visa is dependent on you still being in the UK meeting the requirements of your visa.

For you yes if you want to apply for Tier 2 General. Cooling off period does not apply to dependents.
2. Do we need to go back to our home country (India) to get the visa process.
Your wife must apply from home country yes.
3. Can I come back as dependent on my spouse's Tier 2 General visa ?
Yes.

Thank you for your response "CR001"

Please let me know if the cooling period applies to me even if I come back as a "Tier2 Dependent"?

Sorry for asking the same question, I am a bit more confused regarding this.

However, if you want to then apply for your own Tier 2 General, you will have to wait 12 months from the date you left the UK on your ICT visa.
