Overstay spouse visa by a week

Hi all,

Sorry to say my first post is not a happy one. There seems to be a lack of advice for my exact situation and it’s causing a lot of stress as you might expect.

The background is that my wife and I are happily married, she joined me in the uk (I was born in London, she is from Manila) on a spouse visa. Since then we had a baby boy (also uk National as you might expect).

We had a busy start to the year, and missed the visa extension deadline by a week. We’re now somewhat terrified of what missing it means. Surely this country isn’t going to break up our family for a year or more? Our baby in particular would miss mother as he’s not even one year old yet!

We’re off to the citizens advice on Monday of course, but until then we have an uneasy weekend. So I was hoping we could get a little advice here?

Under E-LTRP.2.2. (b) and 39E, she has 14 days from expiry of leave to make a valid application.
Date of application is subject to 34G.

Thank you for replying.

I had come across that, it’s good to know I was on the right track. A “good reason” is still a worry, but what I’m wondering about now is whether we’d be penalised if she remains in the country while awaiting their response?
I really don’t like the idea that she’d possibly have to be away for a year! I doubt baby would be impressed too...

14 days to apply not 14 days to get a decision from them. You have enough time to get application in.
