180 days absence

Hi everyone,

I recently got my ILR (Feb'18) and started planning to apply British passport for my child who was born a year ago in UK. She currently holds an Indian passport and tier-2 dependant visa. She is currently in India. Her visa expires on Oct'2018.
  • Does she have to satisfy <180 days absence outside UK?
  • If the absence is more than 180 days, what are my options? Can she extend her visa but both parents are ILR holders?

No absence requirement for children born in the UK if under the age of 18, but the child will need to be registered as a British citizen using Form MN1 before applying for a British passport.

Thanks for a quick reply. Are there any time deadlines for registering using MN1? i.e. Can I apply any time before my child's current visa expiry?

You can apply at any time before the child turns 18.
