FLR Spouse Visa - Financial Requirement

Post by carola » Thu Mar 22, 2018 1:44 pm

Good Day

I have been living in UK for 2.5 years on the 5 year route spouse visa, next month I need to send my application to extend the visa for another 2.5 years

This is the scenario:
1- My husband has been working with the same company for 17 months, he has a non salaried job where he earns a different amount every week. Unfortunately, we cannot apply under Category A because his income for the last 6 months do not fulfill the minimum financial requirement ( he had to travel to USA for 2 weeks for personal reasons and he did not receive an income for those 2 weeks)

2- I take care of my young son when he is not in school, therefore, I work part time, also non salaried job, I have not been working with the same company for the last 6 months but I have an income every month.
If we join our both annual incomes, we meet the annual financial requirement, our joint income for last year is around 30K

My questions are:
- According to the HM guide it says: Category A and Category B cannot be mixed
- We cannot apply under category A because my sponsor does not fill the requirement for the last 6 months and I cannot join my income because I have not been working with the same company for the last 6 months (only 4 months)
- If we apply under Category B we need to fill 2 requirement but this is where my confusion starts:

My husband has worked for more than 6 months for the same company.
We can supply payslips and bank statements for the last 12 months, confirming we have received 30K but
what else we need to supply under Category B?
Do we have a chance or the application will be rejected?

Many thanks for your help, really appreciated

Carola

CAT B has 2 condition:

1) Currently earning 18.6k
and
2) Past 12 months earned 18.6k in total

If you fulfil above together combined then you can apply under CAT B

Although category B seems fit in your case where you both have to supply 12 months of payslips & bank statements. But no receiving pay for 2 weeks doesn't mean that you can't apply under category A because under category A non-salaried route the average of last 6 months wages usually be taken to calculate annual wages and only 6 months of payslips & bank statements need. Apply the following formula and if you get required threshold then you can apply under category A with your husband income alone where less paper work otherwise category B will be fine:

Total of last 6 months wages (husband)/6×12=???
