Set(O) or Set(M)

Post by theabrar » Mon Mar 26, 2018 4:53 pm

Hello,

I got my British Citizenship through Tier-2 route, and my wife is on a Tier-2 Dependent Visa now. She finishes her 5 years in the UK next month. I was wondering which application to use for her ILR, as in the link below says
"If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead."
https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa

and takes to the page where it asks to use a set(m) form. She got her current Tier-2 Dependent visa when I was on ILR. So, I'm a bit confused as to which form is to be used for her ILR.

Thanks

Set(O) for a tier 2 dependent.

She does not hold a spouse settlement visa to qualify for ILR on Set(M).

Your link clearly states it is Set(O) towards the bottom of the page
How to apply
Use form SET(O). Check the form for the supporting documents you need.

Post your application to the address on the form or apply in person at a premium service centre.

After you apply, you’ll be asked to give your fingerprints and a digital photo (‘biometric information’).

Thanks for the clarification. But she got her current visa after I got my ILR, wouldn't the statement in quotes apply to her?

But she holds a PBS Dependent visa and NOT a spouse of settled person visa!
