Tier 2 to ILR: 60 day gap

Post by chetankushalappa » Tue Mar 27, 2018 10:24 am

HI all,

Can someone confirm the recent rule change for the 60 day gap between employment/sponsorship is obsolete now?

To be specific:

1. 1st Tier 2 General visa: valid from May 2013 to April 2016.
2. 2nd Tier 2 general visa: valid from Sept 2016

Questions:
1. The gap between April 2016, to Sept 2016 (more than 60 days) will not be considered as a GAP anymore right?
2. I was on tier 2 ICT (and in the UK) prior to getting the first Tier 2 general visa in May 2013. I joined the employer on Sept 2013 (first pay slip generated). So, the 5 year will be counted from May 2013 or Sept 2013?

Appreciate your help/confirmation on this.

Why was their such a long gap in your starting work for the employer from when the visa was issued??

When you say 'contract', what exactly do you mean? Contract job or employment contract provided by your tier 2 sponsor?

through an agency (which is not an umbrella company).. contract between sponsor and agency.. contract between agency and end client. (like most tier 2 contracting works)

Contracting on Tier 2 General is strictly not permitted and is illegal.

Who was paying your salary??
