ILR PBS dependant

Hi All,

My civil partner is on PBS dependant visa (Tier 2) and she is completing 5 years this month. I have below queries about the ILR form.can you confirm please

1.She needs to fill in SET O form ?
2.Does she needs to show evidence of maintenance ?
3.I understand that she needs to show some cohabitance documents .So far she has council,bank statements ,NHS letter and energy bill - for how long this is needed ?
4.Do I need to prove that I am living with her as well like some documents in my name ?

Also just another query. can she apply for PBS dependent extension beyond 5 years as I have PR.

2 years, possibly 5 years. I think the form or guidance notes does say.
4.Do I need to prove that I am living with her as well like some documents in my name ?
Yes.

Yes, provided you got ILR through the PBS route and not long residence route.

How does your partner qualify for ILR if they came to the UK in 2015 on Tier 2? What date was the PBS Dependent visa issued/granted?

She is eligible in next year .sorry it was my typo.

For query #3 there in the form it says (SETO) 2 years from the date of application .Do I need to show it continuously for each month or just 6 months once for two years.

For query#4 - I should also include documents with my name and address - Do you know how many and it is also for 2 years from the date of application ?

For #5 - I got ILR through PBS Tier so her stay can be extended beyond 5 years ?

If she came in 2015, she only qualifies for ILR in 2020 or at the earliest some point in December 2019.

It is too early to answer questions now as anything can change in the next 1 year and 8 months.

I have a new query now .Could you please confirm me that ?

My dependant whose current visa is still valid and I have changed my employer (note that I have PR).
Does my wife needs to re-apply now or she can continue on her old visa until it expires please ?
She is planning to travel out of UK in the meantime so I want to make sure nothing happens when she comes back to UK.

in the dependant visa we have mentioned my old employer details and he provided maintenance letter and all the supporting documents.

She can continue on her current visa. She is dependent on YOU and not your previous employer. She is free to travel.

So just to be clear do you have a reference on any of the UKVI document or website that the PBS dependant
can continue on her visa even after switching the employer. The reason why I ask is when she got the visa it was on the CoS that I had in my visa.

Also will the old employer inform UKVI and asked them to cease her visa as I do not work for them ?

Your dependent is NOT reliant on you staying with your Tier 2 sponsor. She is ONLY dependent on YOU.

You changing jobs has no impact on her visa.
