Childcare and schooling

Post by Reynoldse » Wed Apr 04, 2018 1:20 pm

Hi, my husband and I have British passports but our kids will be getting settlement visas. Will we be eligible for the 15 hours childcare. And then also schooling - will we be eligible.

I can't figure it out anywhere to call to confirm this.

I understand under the settlement visa you don't have recourse to public funds but does the chikdcare/schooling based on the parents immigration status, or the kids?

Schooling is free in the UK for all children unless you opt to put them in an independent school, then you have to pay the fees and there is no government help with this.

How long have you been outside of the UK?

For any type of benefits, there is usually the 'habitual residence test', which you might not pass until at least 3 months have lapsed.

The children are likely to get issued with Indefinite Leave to Enter (i.e. not subject to immigration control) and is the equivalent of permanent residence.

For info, it is the parents that claim, not the children so their visa status is irrelevant for the purpose of benefits.
