WORK RIGHT WHEN YOU APPLY ON UR CHILDREN 7 YEARS ROUTE

Post by mk733 » Thu Apr 05, 2018 1:34 pm

Hi all,

my question is
My ilr application (10 years) was refused last year , due to tax issues,
i am in appeal process.
Currently i am working full time as i have right to work under ilr appeal still in process.

I have 9 years old uk born daughter, if we as family apply new visa on her basis what will be our working rights?
am i going to lose my current working rights ?

You possibly will as the minute you withdraw your appeal (which you need to do before you can apply FLR(FP)), your section 3C protection ends.

You should be aware that FLR(FP) applications can take many months, sometimes well over a year, to process.

Probably not no as your Section 3C ends and you will have no legal status once you withdraw your appeal.

So its mean when we are going to submit new application FLR(FP) .
After submitting FLR(FP) we will lose our right to work unless is decided our favour.
could take years and we will be legal in this country but with no working rights?

You lose the right to work when you withdraw your appeal, which you do before making a new application. Withdrawing your appeal will end your right to work and end your 'legal stay'.

You will be an overstayer then, no work rights and no free NHS either. Your status will only be legal again IF your FLR(FP) application is successful and you will be on a new 10 year route (4 x 2.5 year visas) before you will qualify for ILR.
