I have submitted my T1E extension 8 months ago, and still waiting , I have an opportunity now to work for a company as Tier2, my question is, can I withdraw my application and apply for tier2, or how it works? I headed in case of application withdraw we get the passports at the airport and we would be considered as over stayer!

You must vary the extension to a Tier 2 application instead. Send Tier 2 application with a covering letter saying you intend to vary the previous application

If the decision of the T1E extension was late till the time that you spent already 5 years, can you apply for ILR. Or you have to have an answer for the extension first? Thank you in advance
Yes, you can vary your application to ILR, though I am yet to see a case where the extension has taken 2 years.

How the 5 years get calculated for the ILR? Landing date till application date? And considering you can spend sometime outside UK, can the start date be the visa issue date?
Thank you

You can use Visa grant date unless the gap between grant and arrival is more than 90 days.
But that gap will be calculated as part of the 180 day absence

I made search but I just need a conclusion as still confused,
The accountant software doesn’t have decent RTI format and it only comes in XML coded format. 2 questions please?
1- is that acceptable to HO? Giving the fact that this format has all information it is just not reader friendly!
2 - I saw some posts saying regenerate the report using other software, is it acceptable ? Giving it will have the exact info given to HMRC?

==> HO does not specify the format, so that should be acceptable. It will help the CW if you do the hard work and highlight the relevant infomation
2 - I saw some posts saying regenerate the report using other software, is it acceptable ? Giving it will have the exact info given to HMRC?
==> I have seen those too and it appears to have been accepted. Would not be my personal choice
