Query on ILR eligibility- Trying to Help someone

Hello Seniors/Experts,

This query below is not for me- I'm trying to help someone.

Current Situation: On 5 year Work Permit( Shortage Occupation ) Expiring 25th October 2020. Issue Date of Work Permit 25th Sept 2015. Date of Entry to UK 3rd October 2015

Nationality- Indian

Single mother entered UK on 3rd October 2015 on a Tier 2 Visa with 9 year( dependent 1) younger son. ( work Permit on Shortage Occupation List ).

Elder son ( 2nd dependent ) Aged 14 joined mother on 3rd December 2015.

2 Queries:

1- Mom and dependent 1 will be eligible for ILR together on 5th Sept 2020. Is that right?

2- When will the elder son ( 2nd Dependent ) who is 17 years old ( Born April 2001 ) be able to apply for ILR. Since he will be above 18 in Sept 2020 we want to know if he can also apply for ILR with mom. Also he entered UK 2 months after mom.

Could you please respond to these 2 queries above.

if you dont know the answer atleast can you let me know where i can clarify these queries. ( tried home office but never got a proper response )

You should ask your friend to register on the forum and ask their own questions.

1. Yes

2. Likely within 28 days before date of entry but on a separate Set(O) form and will qualify provided he is not leading an independent life. English B1 and LIUK required.

Will ask them to create their own account.

Good to know mom and dependent 1 can apply 5th Sept 2020.

on your second reply, I assume you meant he can apply 4 years and 11 months from his date of entry to UK. Which means he cant apply with his mom. Did i understand it right

meaning he entered 3rd Dec 2015, so he can apply for ILR on Set ( o) on or after 6th Nov 2020.

But his mom's visa and his visa is expiring 25th October 2020. What to do? please help

small correction- apologies

Dependent 2 ( elder son ) also entered UK same time as mom on 3rd October 2015. However he was away for 8 weeks from 15 Oct 2015 to 15 Dec 2015. After that date he never traveled outside UK till today

so can they all apply for ILR on or after 5th Sept 2020?

Hi, just wanna double check. As your answer to the first question is YES, so the qualifying period does not start from the visa valid date but entry date. Is my understanding correct? Thank you.
