Tier 2 Confusion & Changes

Hi there,

Currently I am under Tier 2 General Visa which expires on 21 Oct 2019
In 25th June 2016 I had married to my husband (British Citizenship)

I will need some advices for the following questions:

1.) What is the requirements to apply the ILR and based on my expiration date of the Visa and when should I start to apply for the ILR?
2.) Given that my husband is British Citizenship, can I apply to settle in the UK, i.e. naturalisation after my Tier 2 General Visa expired?
3.) Perviously I have sat for the Enlgish Test B1 for the Tier 2 Visa application with Pearson PTE Academic, however, back in 25th Feb 2015, Pearson Test of English Academic will no longer be designated SELTs. May I know, I have to resit again for my English Test for my ILR?

4.) Can I sit for the Life in the UK test anytime before the visa expiration in order to apply for the ILR?
5.) Currently I am still working in the country, may I know whether I will need to go back to my home country to re-apply for the ILR after the permit expiration?

Useful to state the date your first Tier 2 General was issued.

See comment above. You also need to meet the required salary at that time, LIUK and B1 English and no absence of 180 days or more in any 12 month rolling period.

Settle = ILR. You cannot apply for citizenship if you do not have ILR. Once you have ILR though and if you meet the 3 year spouse of BC requirements, you could apply immediately for ILR without waiting 12 months on ILR.

You need to do a new test as it must be on the HO approved list. The list changes, so you will need to keep up to date nearer the time.

Yes. LIUK does not expire.

ILR is an application that you can only make WITHIN the UK. Not possible from abroad. You must apply for ILR before your Tier 2 visa expires.

Apologies for the insufficient information:
1.) It was issued during 26th September 2014.

2.) Yes, i do have the sufficient salary and did not leave the country for more than 12 months, because i am working in the country.

3.) Regarding the knowldege of English, in the gov.uk website, they do recommend UK NARIC, may i know whether is worth to go through that? Because my Bachelor degree was taught in English and I can get a medium of instruction (MOI) letter from my University as well as provide the transcript for my Bachelor degree. Or it would be better to go for an English test in the approval list by HO?

I have seen such information about the Knowledge of English from the gov.uk website:

You may need to prove your knowledge of the English language when you apply.
You can prove your knowledge of English by either:
  • passing an approved English language test with at least CEFR level B1 in reading, writing, speaking and listening
  • having an academic qualification that was taught in English and is recognised by UK NARIC as being equivalent to a UK bachelor’s degree, master’s degree or PhD
Also if UK NARIC is not a better choices, do you think I should sit for my English Test anytime from now onwards before the visa expiration?

5.) When should I start my ILR application if my Tier 2 General is going to expires on 21 Oct 2019? Provided I have passed my English Test and LIUK?

You can apply for ILR anytime within 28 days before this date,#

Read my post again. I did not state a 12 month absence but ANY absence of 180 days or more in ANY 12 month cycle.

NARIC and English test both cost the same, £150. English test is quicker. You could do the English test next year, a month or so before you apply.
