Can I work while waiting for the decision on my new Visa Application?

I was on a Tier 4 student visa from the US.

I have finished my course and my visa expired on the 5th of February but I have an FLR(M) application in with the Home Office since the 2nd of February.

What are the rules on working while my FLR(M) visa is being processed? I have read endlessly that you retain the working rights you had whilst on your previous visa while you wait for the decision on your application. However, yesterday a NI employee told me this was not the case.

Does any one have any insight on this?

If you made a valid in-time application, then the NI employee was mistaken.

It seems very unsual that you haven't applied NI when you were tier 4 student. Don't you had the right of work? If so, then by virtue of section 3C these rights will be brought forward until the decision time of application even till the intimely submitted appeal gets not finalized.

I was allowed to work on my Tier 4 Visa. I only didn't apply for an NI number because I had no plans on working whilst doing my studies/dissertation. However, when I finished my dissertation I began working.

I did make a valid, in time application. So one would assume my working rights under the Tier 4 visa carries on into this waiting period right?
