Bringing wife & son from Japan

Post by jungtek » Fri Apr 27, 2018 12:39 pm

Hi,

I lived in Japan but last November I came back to the UK and would now like my wife & son to join me in the UK. I start a new job on 1st May earning 23k / year. I have a few questions I hope someone can help me with.

1. My son was born in Japan. Does he still need a visa if I register his birth in the UK and obtain a UK birth certificate and passport for him?
2. Does my wife have to take an English test before applying for a visa?
3. Do I have to now wait for 6 months worth of payslips before I can apply?
4. Can I apply for their visas on their behalf here in the UK?

Thanks you in advance for any help!

How old is your son?? What is your UK immigration status or nationality?
2. Does my wife have to take an English test before applying for a visa?
Yes, English A1 from a Home Office approved test provider.
3. Do I have to now wait for 6 months worth of payslips before I can apply?
Yes. It is mandatory to submit 6 months payslips and corresponding bank statements for a spouse visa. Do you have any savings?
4. Can I apply for their visas on their behalf here in the UK?
You can complete the form online for them but they have to submit in their home country. You cannot apply for them in the UK.

Are you British by Descent (born abroad to British parents) or British otherwise than by descent (i.e. born in the UK to British parents) or are you Naturalised as British?

I was born in the UK, my parents are both British and born in the UK.

Your son is automatically British by Descent and can apply for a British passport directly.

So is it correct that only my wife needs to apply for a visa to live in the UK?

Yes, but suggest you get the passport for your child sorted as soon as possible.

Thanks so much for your help. I already have the necessary documents for my son's birth certificate and passport translated into English from Japanese so I will do that asap!
