Hello friends
I need Ur suggestions urgently actually I am going to applying Tier 1 visa next month,my uncle gave me 200k and I put it in my account as Fixed deposit.now my uncle saying that as soon as it complete 90 days please return my money with in two days.i discussed bank manager he said he would give Fixed deposit receipt and letter stated that money was there for 90 days.my question is if I apply visa after 90 days n submit both bank documents such as Fixed deposit receipt and bank manager letter n also withdraw the money at same time after applying visa.will it affect my application.
Will home office double check with bank whether money is still held by applicant or not
Please advise
Thanks
Saurabh

You should read the guidance carefully.
Pg 9 of the guidance says
Money used in your application must remain available to you or your business until it is spent for the purposes of your business or businesses. The Secretary of State has the right to request further evidence to verify that the money will remain available. You should be aware that your application may be refused if this evidence is not provided or cannot be satisfactorily verified.
I am sure that answers your question.

The money need to be your money or gifted . No one can lend you money and then withdraw it.
Even you get the visa HO has right request you to show money always available to you or invested to your business in uk. If no money available then your visa could be curtailed.

You can be almost 100% sure that HO will seek confirmation from the bank of the documents you submit, especially as it as overseas bank.
It is then quite likely they will ask if the money is still there.
But even if they don't, how do you plan to make the investment eventually ?

No, you cannot do 'contractual jobs/employment' on a business representative visa.

You are mistaken. This is not possible on a Tier 2 visa.
You cannot be on the payroll of another company.

They are doing so in breach of their Tier 2 visa conditions as it is illegal to work for an umbrella company or do contracting jobs and they will find out soon enough if they wish to apply for extensions or ILR.

Third party does not need to have the funds for 30 days.
The guidance document specifies the requirements and has a couple of templates for the letters needed at the end of the guidance.

Have you read the guidance ? If not, please do so. It clearly sets out the evidence needed in this case under the Title:
Money from third party funds, including Venture Capital funds and money from a third party which has been held by you for less than 90 consecutive days

Hi Marc
Thanks for your reply.
I have gone through guidance but still no idea how third party will prove that they are capable to sponsor me.how home office will evaluate financial strength of third party such as balance sheet or third party bank statement showing money has been held for 90 days. I belive you got my point.
Thanks

You are not the CW. It is their problem as to how "
home office will evaluate financial strength of third party".
Your responsibility is to prepare, collect and submit the documents that they have requested.
That includes
viii) A letter from each financial institution holding the funds, issued by an authorised official of that institution, confirming in each case the amount of money that the third party intends to make available, and that the institution is not aware of the third party having promised to make that money available to any other person.

I don’t know your friend but maybe he has some inside information others in this forum are unlikely to have.
I do wish you would read the guidance document- at least I have not seen anything there or in the immigration rules about blood relatives being a requirement

Hi Marc,
I got lil problem brother, my uncle just called up half an hour ago n said that he is being afraid showing money as third party, as he will come under the radar of Income tax and embassy too. now he himself suggest me that he would make Fixed deposit 200K STERLING POUND (FD) to my brother name and from my brother ,I can do third party and he would sponsor me. is it possible?
if possible do my brother need to maintain the fund fro 90 days or immediately he can do third party .
thanks
