Tier 2 to ILR dependent guidance

Post by Arham » Tue May 01, 2018 7:28 pm

Dear all,

My Tier 2 visa started in Aug 2013. I will be applying for my ILR this July. I have a few questions. Kindly guide me;

1) My wife joined me in June 2015 (2 years after my Tier 2 started). If she applies for ILR dependence with me this July, will her 5 years start again from scratch?
2) If she does not apply for ILR dependence with me, can she get an extension on Tier 2 for 2 more years? Also what if I change my employer after my ILR? How will that affect my wife's visa status, will she still get a Tier 2 dependent status or not?

Your response will be highly appreciated.

Kind regards

Yes, if she switches to ILR dependent on form FLR(M), her clock will reset to zero and she will have to wait another 5 years (2 x 2.5 year visas) before she can apply for ILR.
2) If she does not apply for ILR dependence with me, can she get an extension on Tier 2 for 2 more years? Also what if I change my employer after my ILR? How will that affect my wife's visa status, will she still get a Tier 2 dependent status or not?
She can apply for a PBS Dependent visa extension, the rules allow it. She is dependent on you not your employer. She will get a 3 year extension as Tier 2 dependent.
