Eligible for UK Passport?

Post by Mkdes » Thu May 03, 2018 12:37 am

Hi. I’ve been trying to figure out if my father is eligible to get a current UK passport. He was born in Trinidad & Tobago in the 40s when it was a British colony, and he still actually has his British passport issued in 1950. He immigrated to Canada shortly after and is now a Canadian citizen. So it’s been a bit of a tricky one to figure out. If this works out, we were hoping to see if I could obtain a UK passport because of this as well. (I was born in Canada)

Thanks for any help or any direction you can provide us with!

More likely no because he definitely had surroundered his British nationality over Canadian nationality. And regarding British colony then a lot countries were British colony in past but their residents can't claim to be a British national now. I know few whose ancestors fought second world war with proven record for Britain but they facing severe visa gaining problem.

Unless he was born in the UK as currently constituted or had a familial connection to the UK as it is currently constituted (i.e. one of his parents was born in the UK), he will not be a British citizen.

Section 2 of the Trinidad and Tobago Independence Act 1962 provides for people who were CUKCs (Citizens of the United Kingdom and Colonies) solely due to their connection with Trinidad and Tobago to lose their CUKC status. Therefore, your father would have lost his CUKC status then.

If he retained it but had no familial connection with the UK, in 1983, he would have become a British Overseas citizen, which does not carry the right to reside in the UK AND is not inheritable.
