Dependent visa for elder sister

Post by prakashsingh » Mon May 07, 2018 4:27 pm

Hi,

I am from India (unmarried) and working in UK and holding a Visa exempt Vignette as I am an employee of an International Organisation and does not come under UK Immigration control.

My both parents have passed away. I have an elder sister who is legally divorced and totally financially depending on me. No other close sibling or relative.

I am the only family that she has and she is the only family I have. She is 37.

I want to bring her to UK on dependent Visa or any alternative visa.

Could somebody guide me on this please? Is that even possible, and if yes, then what documents and evidences will be required?

Are you looking for her to move here permanently or as a visitor?

Worth reading through this FAQ on the Gov.UK website.
4.2 EXM4(b) wrote:Exempt vignettes for qualifying diplomats and dependants may be extended in the UK through DMIOU. Exempt vignettes expire once a diplomat and or dependants complete their posting.

In the most exceptional circumstances, elderly parents who formed part of the diplomat’s household prior to their departure for the UK and who are wholly dependent on the diplomat may be considered for an exempt vignette if they are living alone with no relative to turn to in their own country. All applications must be referred to DMIOU. DMIOU will require confirmation of the applicant’s financial circumstances (assets / property ownership), medical condition, whereabouts of applicant’s other children and length of time applicant has resided with the diplomat (sponsor).

Grandchildren and other family members of a diplomat accredited to the UK do not qualify for exempt vignettes. Please see OPI 438.

Any queries concerning the eligibility of dependants should be referred to DMIOU.
The requirements for a dependent visa are onerous and besides, require you to be settled in the UK. As CR001 has advised, visit visas requires proof of strong links back home, essentially satisfying the ECO that she will return back to her country of ordinary residence.

From the information you have provided, your sister won't qualify for an Adult Dependent visa. This route has been virtually closed since the Immigration Rules were tightened in July 2012 and is now only possible for a relative who needs daily care for basis tasks such as bathing, dressing, preparing food etc.

Also that care must either not be available in their home country, or is not affordable.

If you apply for this category of visa and it is refused, the door will be closed for visitor visas in the future, due to the prior intention to settle, There have only been a handful of successful applications since 2012 and these have either been from a country where the care costs are higher than the UK (for example the USA), or after a lengthy and costly appeal through the Court.
