FLR (M) Advice

Hello,

I am seeking advice regarding an unmarried partner visa.

I am currently on a Tier 2 Shortage visa, and would like to change to unmarried visa primarily for employment freedom. My current visa does not expire until 2019.

1. Am I eligible for unmarried partner visa, as it is not "28 days before your current permission to stay in the UK expires?"
2. As I am currently here on a 'work' visa, am I correct in saying I can use my own income to meet the financial requirements?
3. My partner ha received a simple caution, which was immediately spent, will this effect the application?
4. Can we utilise the premium same day service for this visa application?

What is your partners immigration status?
1. Am I eligible for unmarried partner visa, as it is not "28 days before your current permission to stay in the UK expires?"
You can apply at any point provided you meet the requirements, including the mandatory evidence of 2 years cohabitation in a 'relationship akin to marriage'.
2. As I am currently here on a 'work' visa, am I correct in saying I can use my own income to meet the financial requirements?
Yes.
3. My partner ha received a simple caution, which was immediately spent, will this effect the application?
No.
4. Can we utilise the premium same day service for this visa application?
Yes.

Supporting Documentation

Hello,

I am applying for a FLR (M) as an unmarried partner from a Tier 2 visa. Regarding supporting documentation I hope to include 3 x council tax documents spanning over the 2 years we have lived together, as well utility bills.
Is printed versions of the originals acceptable as supporting documents, or do they need to be the original documents posted to us. They do no show to be e-copies when printed (like bank statements, etc.).

Must be originals.

You will also need more than just utility bills and council tax.

Thanks for much for the prompt reply. I was also planning to include tenancy agreements and letters from landlords/ real estate agents. Would this cover it?

You need more than that for an unmarried partner visa.

Read page 64 of the FLR(M) form to see what HO expect to see. For UPV, HO also want to see 2 years of joint commitments etc.

Most of these visas fail because the bare minimum is submitted. These applications are heavily scrutinised.

Would the following be sufficient for 2 years of cohabitation ?

- 3 x council tax bills (both names) spanning 2 years+
- 3 x tenancy agreements (both names) spanning 2 years+
- Joint bank account (both names)

What would joint commitments include? (I do have page 64 in front of me, but this seems to refer to bills, GP letters, etc.)

I have also noted on FLR(M) 13B the options are only for
- marriage or civil partnership

Is this the correct form?

So as many separate utilities you have, plus any other letters HMRC, DVLA, NHS etc addressed jointly to prove you are both 'living together at the same address' plus what you have listed.

13B is not relevant to unmarried partner.

FLR(M) is the ONLY form for the category you are applying for.

FLR (M) Application form questions

Hello,

I am looking for clarification regarding a few points in the FLR (M) form.

1. I have permission to work in the UK and meet the finanical requirement from my base salary, however, I incur a lot of incidental overtime. When answering 7.3 "Meeting the financial requirement" should I put my current gross salary with incidental overtime, or my base salary?

2. Section 7.3A, if I meet the financial requirements alone, do I need to enter any details about my partners income, etc.?

3. Section 9.15, my previous visa appointment was in Brisbane, Australia. Any ideas which 'British diplomatic post' was involved?

4. My partner and I have also lived in shared accommodation (always below the overcrowding rules), at two locations over the two years. Do we need to provide property inspection reports for both? And other than tenancy agreements, should we include a letter from the landlord. What should this include?

5. Our current lease ends 1 month after our visa appointment, would it be pertinent to obtain a letter from the landlord explaining this is to be extended?
