Tier 1 Entrepreneur + Tier 2 General ILR

Hello Guys,

I am going to apply for ILR this month based on 5 year route (3 years on T1 Ent + 2 Years Tier 2). I have done the business for 3 years under T1 Entrepreneur leave but few things could not go as per the plan and could not create 2 jobs and since paying salary was the only major expense in my business (Software consultancy), I did not spend £50K. Hence I did not go for T1 extension and switched to Tier 2. I had been paying CT, SA and VAT regularly.

I just wanted to know if not creating jobs or investing enough money under tier 1 could affect the outcome since I am going to apply for ILR under Tier 2 but need to include 3 years I had spent under Tier 1 Ent.

I really appreciate your help.

You should be fine as there are not such requirement for ILR under Tier 2. However there is small probability that they ask you to show that you had access to 50K throughout those first 3 years

Thanks Zimba. I had access to more than 50K for 2.5 years until I bought a house :D

I was just wondering do I need to mention absences from UK when I was under Tier 1 and if yes, do I need to submit any document for that? Anyway most of my absences were less than a month/year.

You need to mention all absences. Tier 1 Ent is also a PBS visa and the same absence rule applies as for Tier 2 General.

Thanks Zimba for confirmation. I also thought so.

Fingers crossed. So far I never had any issue in getting visa. Not sure if being on 60K salary makes it easier to get ILR.

Makes no difference what you earn above the minimum £35,500. You need to meet the ILR requirements to be successful.

Hello Moderators,

Sorry to be pain. Does any one remember coming across someone with the same situation as mine on this site? I have tried to find similar posts but seems like there is none.

I am just trying to figure out what HO will possibly ask for my 1E leave. (Zimba had answered this but just want to make sure from someone who has really gone through this.)

Such cases are quite rare. The chances of you being asked questions regarding Tier 1E period are very low

Got it. Thank you @zimba88 and @CR001.

For anyone in the same boat, I guess as far as you can show that you were genuine entrepreneur, you should be fine. No questions asked about T1 E. I had submitted CT and SA confirmation letters from HMRC and few print outs from CH website. They do ask for photocopies of all the original documents, so do carry them with you.

For T2, they will tell you what documents needed. For T1E, Please include CT filing confirmation and SA statement letters for all 3 years. (You should have received them from HMRC or Accountants letter to confirm the same.) Also include filing history and appointment page printouts from CH website, Incorporation certificate and VAT registration certificate.

I'm in exactly the same boat as you were (T1E - 3 years, then switch to T2 General for 2 years) and I'll be applying for my ILR in early January 2019. Your advice has been very helpful.

In addition to Corporation Tax filings, Self-Assessment statement letters, filing history, company appointments, VAT certificate and Incorporation certification, would we also need to show any of the following:
-Business account bank statements (3 year period)
-Business contracts
-Business insurance documents

I understand you already applied for ILR and have been successfully granted the ILR too ?
Also, you did not submit any evidence of having access to £50k throughout your time on T1Ent ?
How did u showcase of being a genuine Entrepreneur ?
and for Self Assessment what evidence did u show ? was it SA302 ? or email submission confirmation print out from HMRC ?

Hi Guys,

I have read the guidelines from HO and it states -

"You cannot combine Tier 1 (Entrepreneur) leave with leave in any other category to meet the continuous leave requirement.'


Is this a new amendment to the rules? Could you please URGENTLY reply that T1 + T2 combination is still valid for an ILR application?
