Spouse visa complications

Post by Mafiq » Mon May 14, 2018 12:19 am

Hi,I am a British by Naturalization. My wife and my 4 years boy are living in Bangladesh. I am preparing to apply for them from Bangladesh. Now, My wife I pregnant as well. I have few questions:
1) I know the new born baby will be British by born as I am a British, what will be the status my first baby? Can he apply for British Passport once he comes or has to wait for 5 years. Because, I am little confused from guidance of Home Office
where it says: British Citizen may descent to one generation born abroad. So a child born abroad to a parent who is British otherwise than by descent will automatically British by descent.
What does it mean? Can you clarify, please.
If he is British by descent, Can I apply for his Passport from Dhaka?

2) I have to show £22400 as proof of my income to apply for them. In that case, Do I need to show any amount as a saving either in my account or her account? If so, how long I have to keep that amount of money?Referring to the first question, If he is British by descent, In that case, still I have to show £22400 income? Is that income as a gross or net income?

Your post has been moved to your own topic from the other member's thread you had tagged your question onto. Apart from your situation bearing no relevance to the subject there, it also confuses confusion and is unfair to the member who opened the topic.

Please continue to post here.

What date did you become British??

If you only became British after your first child was born, then the first child is not British and will have to apply for the same visa as the mother.

Your second child will definitely be able to apply for first British Passport.

Your first child's depends if he was born after you were Naturalised - then he can also apply for first British passport too.

In which case you will only need to show £18,600 salary for the wife.

What is your current salary? and how long have you lived in the UK?

I came to the U.K in 2005. I got my ILR in 2015. My first baby was born in 2014.
So I have to show £22400 as a annual income as my boy has to get the same visa with his mother. Is it right?

You may have to wait until baby is born and you have their British passport. You may then be able to apply for settlement for the other 2 people.
