ILR SET M - question on Section 4

Hello, Just a quick one, but I've been on a 5 year route for my FLR (M) visa and have an appointment on Thursday for IRL Set M. In Section 4 of the application they ask if you're:

1. a spouse of a person present and settled in the uk - 2 year route
2. OR partner of a person present and settled in the Uk - 5 year route.

I assume it's the partner 5 yr route as that's how long I've been on the visa track, but we are married (spouse).

Any advice?
