ILR dependant VISA

Post by adi27 » Thu May 17, 2018 4:50 pm

Hello,

I'm currently a resident of UK with Tier 2 Gen VISA. I will be eligible for ILR mid of next year. My family (wife and child) who are living with me here in UK will only be eligible for ILR end of next year. My question is :

Scenario 1: If they leave UK for about 6months next year (July 2019-Dec2019), will they still be eligible to come back to UK and apply for an ILR? Will if effect 5 years residency requirement? If say my ILR is approved, will they be given any consideration based on that fact?

Scenario2 : If they leave UK next year with no definite date of return, but I stay here and end up getting an ILR, will they be able to travel back to UK as ILR dependants? Is there any such thing called an ILR dependant?

Thanks
Adi

Absence of 180 days or more in any 12 month period makes them ineligible for ILR based on the new rules introduced on 11th January 2018 (for absence after this date).

Switching to spouse visa (what you are calling ILR Dependent) route after you get ILR resets their clock to zero and a new 5 year route (2 x 2.5 year visas) before they will qualify for ILR.

Spouse visa (what you are calling ILR Dependent)currently costs £1,523 each PLUS £600 IHS each. IHS is likely doubling by the end of the year.
