Spending most of our time in Spain and my partner's FLR application in 2020

Post by jdzeuro » Sat May 19, 2018 6:58 am

My spouse (US Citizen) is with me in the UK on a Spouse/Partner visa for 7 months now. I am a Spanish Guitar Constructor and we would like to rent a second apartment in Spain while keeping one here in the UK with the desire to spend more than 6 months there in any year period.
We would always be together either here {UK) or there (Spain) with proof of our joint cohabitation in both places.
Which issue is most important; her being in the UK most of the year or cohabiting with me all the time?
I was about to sign a lease in Spain yesterday then cancelled as I did last minute research and found the discussions about maximum days away per year etc...
Thank you.

Is it a spouse visa or an EU Family Permit/Residence Card if you are Spanish??

Confusion as you stated Spanish.

Ok, no need to stress as there is no absence limit for spouse visa holders.

The important this is that you are required to be 'settled' in the UK based on her visa and for extension submit evidence of your income and bank statements again in addition to proof of accommodation and the cohabitation evidence which is mandatory for unmarried partners.

She also can't remain long term in spain as a visitor, she would need a residence card to be able to do that. Be careful as many EU countries do not recognised unmarried partners or durable partner relationships.
