Deceased parent nationality status

Post by HWDO5 » Thu May 24, 2018 3:51 pm

This is in connection with my enquiry with the German embassy around hopefully meeting their criteria for an application for dual UK-German nationality. They responded to my initial enquiry and 3 subsequent exchanges within 24 hours of each of them (!)

My query relates to establishing wether my late mother kept her dual (German) nationality when she came to England and I given she had a British Passport issued to her , I believe ultimately applied for gained British citizenship in the 1960’s.

I called the Home Office helpline (0300 1232253) and was told for this type of enquiry to 'probably use the Form NS for this'. I have completed as much of the information as I could (and that seemed relevant) and sent with the attached copies of the birth and marriage certificates, that was 3 months ago and I cannot get any response from the HO or Passport Office even to confirm wether my original enquiry has been logged.
Sadly my Father who would have more information has pre-deceased my mother, and there are no other relatives who can assist me in my enquiries for further information. Additionally I cannot find the original or copies of her passport. Enquiries with the National Archive office have so far proved fruitless.

Any help in where I would be best advised to go to find out the required information would be appreciated.

From my limited knowledge of the subject I believe that, to retain German nationality when gaining another one, one would have needed the "Beibehaltungsgenehmigung" issued by the Bundesverwaltungsamt. And it may not have been uppermost in your mother's mind to research this at the time. Currently, when taking on another EU nationality German nationality is retained. Outside the EU (and probably post-Brexit for the UK) the above approval needs to be applied for. The link gives some details on the subject (in German only): https://www.bva.bund.de/SharedDocs/Kurz ... chaft.html

As far as the Home Office is concerned I believe a lot of documents have been disposed of and maybe form NS won't provide any clues.

I would advise you contact the Bundesverwaltungsamt directly to see whether they can give you any information. There's a procedure called "Feststellungsverfahren" which is similar to form NS where they will help to establish whether someone is/was still a German citizen. http://www.bva.bund.de/DE/Themen/Staats ... -node.html
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.
