Tier 2 ICT Dependent Visa to Tier 2 ITC Visa

Hi

Myself and my wife were working in the same company (reputed multinational company).

I came to UK in 2016 under tier 2 ICT visa and my wife came to UK a months later on Tier 2 ICT dependent Visa.

Based on my wife request my company agreed that she can continue her Job in UK on ICT dependent visa and she is working for last 2 years in Uk.

My ICT visa is expiring on May 2019.

Need help on the below questions

1. Can my wife apply for Tier 2 ICT Visa from UK before my visa expires Or does she needs cool off period ?
2. If she needs to get Tier 2 ICT - How long she needs to be in India ?
3. If she gets ICT visa can i apply for ICT depended from UK ?

1. She cannot 'switch' within the UK. https://www.gov.uk/tier-2-intracompany- ... -this-visa Cooling off period DOES NOT apply to dependents changing to main applicant visa status.

2. She can also only apply for ICT if being offered a salary in excess of £73,900 per annum without the mandatory requirement of 12 months working for the company in home country. https://www.gov.uk/tier-2-intracompany- ... orker-visa

Why is she opting for ICT and not Tier 2 General?

than you very much for your prompt reply (that's very quick)

Unfortunately My company's internal policy has few restrictions on Tier 2 General Visa's, So we have very less chance.

But we can easily get Tier 2 ICT Visa.

We both worked in the same company for more than 5 years (3 years in home country and 2 years in UK).

So need your help to validate my below understanding please.

1. My wife needs to go back to Homecountry before my visa expires and apply for Tier 2 ICT without any Cool off period
2. She already worked for more than 3 years(2013-2016 ) in home country before she continued in UK - so my assumption is that she does not needs to be more than 73k per annum


If this is ok then we are in good position else we need to search another job to get sponsorship for Tier2 General(for my wife).

It is the most RECENT 12 months immediately prior to application of employment in home country if not earning £73,900pa. Not a period 2 or 3 years ago.

If she is not offered or going to earn that high level of salary, to qualify for ICT it is the 12 months home country employment as payslips have to be submitted to prove the home country employment.
