EEA4 for a durable partner - correct application date??

EEA4 for a durable partner - correct application date??

Hi there,

I am a silent follower of this forum and I would appreciate if someone could please share some advice. I am an EEA national with a permanent residence card dated February 2018. My partner (Non-EU - durable partner) was issued a residence permit in June 2013 (5 years - expiring on the 15th of June). I am the sponsor. Since it is 2 weeks now until my partner's permit expires we wanted to apply for a PR for him too. We had a meeting with a solicitor last week and at the end of the meeting she told us she will be sending the papers to the HO that same day (24th of May), I had a bit of a discussion with the solicitor as far as I am aware my partner needs 5 years of residence from the date on the sticker in his passport - in my understanding he could only qualify on the 15th of June 2018 for PR. Just so you know that same solicitor handled my partner's residence permit case 5 years ago. She said that I was wrong as the date on the sticker is irrelevant as my partner qualifies earlier - 5 years from the date we sent the application for his residence permit 5 years ago (I think we sent that in April 2013). Anyway I know the documents have now been sent out and there is nothing we can do but I am a bit nervous that the application will be refused as my partner does not fulfil all the requirements for another 2 weeks. Just so you know we both worked full time in the last 5 years, lived continuously together and sent all relevant documents to prove it but we want to get married in a few years once we make some savings. Could anyone advise please?

My understanding is that is date of RC started that counts and kicks off the 5 year residence clock for unmarried partners.

Hello Chauka, I was wondering if I could ask you a question. Im in a durable relationship with my EU partner, we have lived together for over 2 years and have a 5 month old baby together. My partner has been working for much of the time we have lived together. The only thing I have in my name to our adress is the internet and telephone bill for the last two years. My EU partner and sponsore has her payslips,bank statements, tax letters etc to our address.

My question is, my internet and telephone bill for 2 years as well as my child birth certificate, is this enough in your view to make a successful application to the HO as you have gone through the same process your self?
