Section 3C question

Hi there,

Slightly longish question. I'm on an ICT tier 2 visa that expires on June 14, 2018 (my wife's a dependent on the same visa). I've applied for an extension on both our visas via the standard postal service, we had our biometrics taken on April 28, 2018. So, between April 28 and June 14, i have about 7 weeks in which to expect our approvals for the extension. This should be a fair window of time in which to mostly expect to get our approvals, but I see on many forums that some folks haven't heard about their approvals right upto the 8th week (and in rare cases even later). I understand that I'm covered by section 3C and both my wife and I are allowed to live/work in the UK until the Home office makes a decision on my extension application, but problem is, my wife is a contract employee. Her employer is unaware of section 3C and so is okay to extend her contract post the visa expiry date of June 14 "only" if we get our approvals/new BRP by the 14th.

1) How does my wife convince her employer that she's allowed to legally work on the same visa until we hear of a decision on the extension from home office?
2) Are our current BRPs valid (even if expiry date has passed) until we receive new BRPs?

Hi there,

Indian national here in the UK. I've applied for a tier - 2 ICT in-country extension (standard postal service) and understand that it can take upto 8 weeks from the date of biometrics. Just wanted to know from others' experiences if it takes "exactly" 8 weeks for the approval. I'm currently on week 5 and haven't heard anything yet. Have any of you guys gotten your approvals within 6 weeks of your biometrics (on the postal service)? Also, once i get the approval (via email i suppose?), when can I expect to get my passport/new brp?

Google Section 3C of the immigration rules and show her employer. Her employer can also do the employee status check online with HO.

No, your visa has expired BUT if you submitted an extension application BEFORE your visas expired, then you have section 3C protection.

It takes up to 8 weeks, sometimes a bit longer.
Have any of you guys gotten your approvals within 6 weeks of your biometrics (on the postal service)? Also, once i get the approval (via email i suppose?), when can I expect to get my passport/new brp?
You get approval by letter in the post. BRP cards are delivered by DX Couriers, usually within 10 days of approval.
