ILR entrepreneur and dependent extension

Hi zimba,

A quick question, i have to apply my wife's visa as dependent when am applying my ILR as i have completed 5years on pbs entrepreneur tier 1. Now my question is, my self assessment is about 12000 (all of it is directors salary) and my wife is employed in my company itself and i pay her 9000 annually. So for her to be qualified as dependent can we sum up both and claim 21000 as income? And she has gone on maternity (claiming maternity pay) as well so can i use her 9000 salary to make up as above? Please clarify..

There is no minimum income requirement for a PBS Dependent extension.

Is it not that we need 18600 min income if main applicant is self employed?

Not if you are continuing as a PBS dependant, which is what you should be doing.

Ok thanks, just to clarify

Is it because when i am applying for my ILR based in my 5 years of pbs (tier 1 entrepreneur visa) my wife will still be dependent based in this category and once i get my ILR and if she will have to switch once her visa expires?

Situation is i am eligible for ILR based on 5years, but my wifes visa expires on same date as mine. So i need to apply for her extension but i was confused which category she will be in? Can you pls clarify. Thanks

She DOES NOT have to switch visas.

She can continue to extend her PBS dependent visa before it expires until she qualifies to apply for ILR. The rules allow this but only if you get ILR based on 5 years residence PBS route.

And to add to that. If your dependant switches to the family of a settled person, the ILR clock gets reset.

So, it is important that you use the PBS dependant form to renew.
