Spouse Visa Non-Salaried and paid weekly

Post by arfinkhan128 » Sat Jun 02, 2018 9:59 pm

Hi

I am non salaried and get paid weekly only for the work that is undertaken by me. I understand that the calulation for non salaried is different to salaried as work can vary for non salaried.

As I am aware you need to provide 26 Payslip’s if you are paid weekly. Does it have to be 26 Payslip’s for every week in the last 6months?

What if I had last 26 Payslip’s from the date of application however they don’t cover every single week because in April 2018 I was in holiday for three weeks and am missing three weeks Payslip’s so I only have one payslip for April. Would that matter for non salaried?

If those 3 weeks were part of your annual leave then your employer must have paid you and for that you must have been given payslips. Otherwise if these were unpaid then I think still employer can issue you payslips with nil figure just to meet the requirement alternatively the employer can issue a letter explaining that for which I m not sure whether will work??

Hi seagul thanks for your advice a nil figure payslip would have never crossed my mind. I work for an agency So i do not get annual leave. If they cannot provide me nil figure Payslip’s but can provide me only a letter saying I was on holiday which was unpaid. Do you think I should apply with just the letter?

Maybe you are unaware about your rights. Regardless of whoever you working for, you have a right of paid holidays usually 5.6 weeks and if working irregularly then the average of usually last 3 months is being taken to calculate it. Try to ask for payslips with nil figure which can be possible otherwise HO might treat it as missing.
