My dad was British in 2010. I came in the UK on 5th January 2014 with my mum in visa ((VISA TO ACC MOTHER / CYR <MOTHER NAME>). I was under 18 while I applied for my visa, but I am over 18 right now. We extended our visa (Further Leave to Remain) in 2016. After 2016 I am in “Dependent Leave to Remain” and my mum is on the same visa as previous “Spouse Visa”. My mum is really scared- she thinks she can’t pass Life in the UK, so she is planning to extend her visa again. In 2019 January 5th I will reach 5 years period of time. I have already passed Life in the UK and B1, so I was wondering if I could apply for ILR first or my mum has to get ILR before I qualify for it? Cheers!

I live with my dad and my mum lives separate. In 2018 August 5th I will reach 5 years period of time. What will be in our case? Will I be eligible for ILR?

Why is your 5 year elapsing on the 5th August.

I thought you will qualify in January 2018.

In any event, you should qualify at anytime under 298c, provided you are living with your father as opposed to your mother.
