EEA Family member PR

Post by samm202 » Tue Jun 05, 2018 11:42 am

Dear Members,

I was wondering if anyone can help me here.

My case details are as follows:

I came to the UK in February 2011 as student. I got PSW in 2012 which was valid till December 2013. I then got married with an EU national in August 2013 and got my residence permit in Jan 2014.

I have following questions:

1- Can I apply for PR after completion of 5 years of my wedding or 5 years count down start from the day I had received my residence permit i-e Jan 2014
2- Can I apply for British citizenship straight after getting PR? Considering I have been in the UK for more then 6 years (Under UK and EU law)
3- What documents will be required for PR application

Thanks in advance

Regards,
Sam

1. It counts from date of marriage. So you can apply for PR in August 2018, whatever date it is you got married (assuming you married within the UK).

2. Is your spouse British?? If not then you have to wait the required 12 months on PR. It is 6 years yes, but that must include 12 months on ILR/PR.

3. Have you read the form??

Hi,

Thank you for your answer. yes, I have read the form.

Another question, just to make my application simple:

1-Can I apply alone without my wife? I don't want to apply for my wife as she has points on her driving license
2- My wife has a few months of gaps in work. Will this be a problem?
3- She doesn't have payslips or P60s for one year. Will HMRC work history will cover this? (Her salary is stated in her bank statement)

Thanks

Hi,

Just to confirm that she has received 3 points on her EU Polish license for over speeding with 100 pounds fine in UK

Thanks
