tier 2 general dependent visa

Post by jamrood » Tue Jun 05, 2018 12:34 pm

Can someone help me with my below queries regarding Tier 2 General PBS Dependent Visa extension please?

Please see below my case:

I got my ILR in Apr'2018. ( Through tier 2 general 5 Years route).

My wife and daughter are under Tier2 PBS Dependent visa for 2 years which will expire by April 2019 ( they are with me in UK from last 15 months).

My questions in order to apply for PBS Dependent Visa Extension for my wife and daughter??

1) I am looking for contract based jobs and If i leave my current permanent job, and if i assume that if i dont get any job for next 6 months or dont get any job till April 2019 - Can my wife & daughter are still eligible for Tier 2 PBS dependent Visa extension as long as if we maintain enough funds for 90 days?

2) What is the maximum gap that i can have from one job to another job?

3) In order to apply for my wife's PBS dependent Visa extension do I mandatoryly have to have Permanent job or contract job or it does not matter whether I have job or not?
4) My wife does not have any job and not expecting any job until next 2 years.

Please let me know your thoughts.

Thanks a lot once again.

1. They can still apply for an extension. You do need to prove maintenance funds for 90 days though and that you can maintain yourselves without recourse to public funds.

2. As you have ILR, there is no 'maximum gap'. Not sure why you think there is.

3. You have to be able to support yourselves.

4. A PBS Dependent does not have to work.

Dear CR001,

Thanks a lot for your immediate reply. Re: Point 2, just I was checking and making sure that whether I need to have any job to apply for my wife's PBS dependent visa extension or not?

Re: Point3: You have to be able to support yourselves - can you explain bit more please.

Finally what documents do I need for PBS dependent Visa extension:
1) Marriage certificate
2) 90 days funds maintenance
3) Passport and BRP cards
4) 2 passport size pohotos
anything else please? Thank You very much.

You should be able to support yourselves without recourse to public funds.

See the guidance notes.

Maintenance requirement
67. Please refer to paragraphs 319C, 319H and appendix E of the Immigration Rules.
68. One of the requirements for family members of Points Based System Migrants is that you must be
able to support yourself for the entire duration of your stay in the UK without needing help from
public funds (for example benefits provided by the state). If you cannot support yourself you could
face financial hardship because you will not have access to most state benefits.
