I urgently need to apply for ILR for my under 16 years old Daughter

Post by Sahara15 » Wed Jun 06, 2018 5:57 pm

I have already acquired ILR status while the rest family members just qualified to apply last month as they had joined me latter when I first came to the UK.

The issue giving me headache is that I recently came to be aware that my daughter who is currently doing GCSE exams will require ILR if she is to be permitted to go to College in Sept minus being deemed as an international student, which is obviously too expensive in terms of fees. She is currently on a dependant Visa, just as other members of the family and the Visa comes to an end next year.

My questions are as follows;

-Can I apply for her alone on a fast track-premium now while am still trying to organise funds for the rest family members to apply for them latter?

-How much is it for premium for someone under 16 and how long can it take for the Visa to come thr on premium?

-Can I apply on-line, if its only by paper application, which form do i use?

-Will she be required to go for Biometrics, considering her age?

Your guidance will be greatly appreciated over this matter.

Kind regards.

For your daughter to get ILR, both parents need to have ILR.

So, no, you cannot apply for her alone either as a premium or postal application.

What is the visa category you came on??

Your daughter can go to normal Sixth Form at a state school at no cost.

Thanks alot for the feedback. Its very reassuring to hear that she can actually go into sixth form on local conditions. All I have been hearing is that without Indefinate stay status, she can not be allowed to enter college come September unless I agree to pay international fees.

I came in as a Student, on a student Visa and then worked my way through to acquire my ILR based on ten years stay.

My family members also qualified to apply for ILR based on ten years last month. All is fine for them, no criminal record history nor bankruptcy but its a bit little tricky money-wise to apply at one go for all the 4 other family members.

My first born daughter and my second born were both born in my native country but started school here in year one and reception respectively. My third born daughter was born here and currently in year 1.

Your further advise will be greatly appreciated.

Very important to state all the facts when seeking advice from volunteers on a forum. Had you stated the above, the answer would have been different,

If she has 10 years legal residence and meets the requirements for ILR based on 10 years long residence including the absence limits, then yes she could apply for ILR 10 year LR.

UK born daughter can be registered as British under Section 1(3) of the nationality act, which is an entitlement to register (if not already done).

Thanks for your quick response.

So can she still go to college in Sept minus being considered as an international student?

Can you also touch on the questions I had raised in my initial statement above.

Kind regards and thanks a million times for this essential feedback.

Yes, on form Set(LR).
-How much is it for premium for someone under 16 and how long can it take for the Visa to come thr on premium?
£2,999 for premium service. Usually decision on the day and BRP card takes 7-10 days.
-Can I apply on-line, if its only by paper application, which form do i use?
Online to book appointment but a paper form for ILR - form SET(LR). I believe she can also use Set(F).
-Will she be required to go for Biometrics, considering her age?
Yes, there is no exemption or special treatment for her. Biometrics are done as part of the process on the day of her appointment.

Even without ILR, she is not liable to pay any fees for government school Sixth Form. Not sure who told you this or where you heard this.

I am humbled and chuffed by your splendid answers-thanks alot, cant thank you enough.

I knew I could rely upon this board because even in my years of strive for visas as a student and for IRL,(under different username) this board was my homeground, my bread and butter day and night and the hits i got from here played a major role to my surviving the chop from home office-my cases wr one hell of a complication.

Thanks alot and may you continue with your great works for the masses in need.

Kind regards.

£2,389 for postal applications. There is no price difference for kids vs adults. Everyone pays the same fee.
