Returned to Home Country, Received Curtailment Letter

Post by Elle268 » Mon Jun 11, 2018 10:35 am

Hi Everyone

I have been back in my home country for a little while now and have just received a curtailment letter from the Home Office (HO).

Before I left my UK employer, I had asked them to update my address with HO to where I am staying in my home country, however I was surprised that I still received the curtailment letter, as I have left the UK already. Is this usual practice for letters to still be issued?

The letter requires me to return my Biometric Residence Permit (BRP), which I will return – is there a time limit before they issue the fine? Will HO confirm to me that they have received the returned BRP once they receive it?

I was also going to enclose a cover letter to inform HO of the date I departed the UK. Should I include any other information? I just want comfort that the HO are aware that I have indeed left the UK.

Many Thanks.

Many Thanks.

Thank you for your response CR001.

Having re-read the letter again (dated late May 2018 but only recently received), I have since noticed some things which hopefully someone can assist me with.

1) Under the “Reasons for Decision”, it says: ‘The Home Office was informed by [employer] on 19 March 2018 that you have ceased to be employed by them’

My last day at work was on 23 March 2018, so I would have thought the Home Office would be informed after this date (within 10 days) – is this correct? I have asked my UK employer to confirm which date they informed the Home Office and am waiting for a response. Depending on this response, is there anything that needs to be done?

2) The letter provides a leave curtailment date to early September 2018. I have already returned to my Home Country, so I guess this is irrelevant, but why would Home Office have given me more than 60 days from the letter date?

Does anybody have any advice? I would like to return to UK one day, so don’t want there to be any issues.

Many Thanks.
