When is the application actually received?

Post by Kikomoto83 » Tue Jun 12, 2018 12:24 pm

Hi,

I've sent my application by post and it was delivered and signed for on Monday 11th June. Does this count as a date when the application was received or perhaps it needs to register /acknowledged by someone? I was physically present 5 years ago in June but I went away in July. I am unclear on what "received date" actually means - what is the definition?

Thank you

If you post by Royal Mail, your stamp chop is the application date, if by other courier, then the date is the date they receive the documents.

No, if applying by post, it is the date HO receives it. It is not the same as for visa/ILR applications.

Really? why they set different rule?

My understanding is: if you use the other couriers, the date you post the documents may not be found as it may not be stated on the package. So the HO can only determine by the date they receive the documents. If by Royal Mail, there must be a dated stamp chop or stick on the documents, so they can take this as application date.

Will be very unfair to the applicant if the post office delivered late because of whatever reason.

You are confusing the Immigration RULES with Nationality LAWS. They are separate and different and not dependent on each other.

If you post your citizenship application, it is the date HO receives it, same with courier.

If your apply online, date of application is the date you submit and pay online.

If you apply using NCS, the date of your appointment is the date of application.

Now I know they are different, by the fact. But what I mean is what's the rationale of the difference between visa and nationality if applies by post -

Applications under the Immigration Rules do not have the mandatory requirement of being physically present in the UK at the start of the residence period to qualify like citizenship does. They are different rules and different requirements.

Lets not turn this OPs topic into an analysis of why HO does or asks what it does please.
