Switching from Tier 2 Dependant to Tier 2 Main Applicant and IRL

Dear All,

I am in the process of applying Tier 2 General Visa for my self and family. i have a question to be clarified before i apply visa for my spouse.

My wife is army experienced nurse in India and she had cleared the IELTS and hopefully getting an offer from UK soon. But i am an IT professional and i already got an offer from UK and COS issued on my name, but it is for 2 years since i had availed 3 years of COS from 2013- 2016.

so my question here is that what time duration do they (home office) calculate if she switch from tier 2 dependent to Tier 2 main applicant after 6 months (example, she is in UK from June 2018 to Dec 2018 with tier 2 dependent and from Jan 2018 further in Tier 2 main Applicant)

Also another query, does she need to go back to India if she want to apply for Tier 2 main applicant?

Not sure what relevance this is. If you are applying from India, you get a new 6 years maximum period on Tier 2.

Is this question in relation to qualifying for ILR after 5 years??? If yes, then you need to understand that for ILR based on 5 years, you cannot combine time spent in the UK as PBS Dependent and PBS main visa holder to make up 5 years. You need 5 years as either category visa to for ILR.
Also another query, does she need to go back to India if she want to apply for Tier 2 main applicant?
Yes, she would have to apply for her own Tier 2 General from India.
