What about kids ILR?

Hi,

This forum has helped me greatly over the last 10 yrs or so. Now applying for ILR in AUG need some help please.

I am currently on tier 2 dependant, my wife is the main applicant and me and 3 of my children are her dependant, 2 were born in Pakistan and one here in UK. I'll have my 10 yrs completed in Aug and my wife will have her 5 yrs completed on Tier 2 in Nov. So I'll apply for my SET LR first.

Now my questions are:

1. Do we have to submit separate ILR applications for kids and pay £3000 per child?

2. The SET LR has a section about kids and proof of living together, because my kids are my wife's dependant at the moment do I have to mention them in my application? if yes then what proof would be sufficient to show we are all living together?

3. 3rd child was born in UK, do I have to pay £3000 for ILR for her too? :O

1. Yes, for the 2 born abroad kids and they must apply with your spouse via Tier 2 route.

2. You should answer the questions truthfully.

3. If you plan on registering the UK born child as British once you have ILR, then no, you do not have to apply for ILR for the child as the child is entitled to register as British once EITHER parent is granted ILR.

Ok great thanks, but all my children are under 16, so do we have to apply and pay £3000 fee per child? arent children included in the main application?

No, children are NOT included in the main application for fee purposes. Yes they are included on the main tier 2 applicants form for ILR but you have to pay for the parent plus each child.

Each person applying for ILR has to pay the fee, regardless of age. Note that the almost £3k is for in person premium appointments. It is cheaper if applying by post.
