ILR application - Spouse on limited leave to remain visa

Post by Kar123 » Mon Jun 18, 2018 2:49 pm

Hello experts,

I am a British citizen and my wife is on Spouse Limited leave to remain visa due for her ILR in Jan 2019.

I will be going on in an International Assignment / secondment starting August 2018 for a 2 year period and will be returning back to UK to the same employer in Sep 2020. I will also have a letter from my employer confirming the same. I will be paid in non-UK bank account from Sep 2018 until Sep 2020. However I can provide International Payslips from September 2018 onwards and UK payslips until Sep 2018. I meet the £18,600 criteria.

Me and my wife are joint UK home mortgage holders.

My thought was to leave my wife (Spouse visa) and infant daughter (British Citizen) back in the UK until my wife gets her ILR.

We still have the co-habitation evidences like tenancy agreement, council tax bill, joint bank accounts etc.
I can be physically present in the UK while she submits her ILR application in Jan 2019.

My wife doesnt work at the moment.

Could you please let me know of cases where ILR was successful in above scenario. And can you also let me know if I can show my Internal payslips with the same employer for a period of 5 months prior to ILR application.

Appreciate your response. Please advice.

For ILR, you have to show 6 months payslips and 6 months corresponding bank statements where your salary is paid into. If you are being paid overseas, you are not 'present and settled' in the UK.

You should note that your spouse's visa is usually dependent on you being 'present and settled' in the UK.

This is useful to know. Thank you. However could you advise whether will it be acceptable if I apply using Savings route and show enough savings of £41K.
