Residence permit is expiring. What is the next step?

My brother entered UK in August 2013 on dependent spouse visa and he got it renewed it in 2016 and got the residence permit.
Now the residence permit 'spouse/partner leave to remain' is expiring on 15 th of Sept 2018.
I believe he needs to apply for visa renewal.

Please can anyone help me with:
1. When is the earliest and latest he can apply for visa renewal?
2. What visa category he needs to apply visa under?

If has almost 5 years on a spouse visa and meets all the requirements, he can apply for indefinite leave to remain.

He can apply withing 28 days before reaching 5 years residence, counted from the date he arrived in the UK.

He entered first on August 1st 2013 then he was for about 3 months. Then he has been almost always in UK except for couple of weeks of short holidays etc. abroad.

Would he be eligible for ILR now or he has to renew the spouse visa again now and then change to ILR in few months ?

I am on 'Find out if you can apply to settle in the UK'.
I am not sure what to put for '2 Did your family member or partner settle before they became a British citizen?'.
SIL(sister in law) had below visa categories before she became a British Citizen:
HSMP --> Tier 1 ---> ILR ---> British Citizen. My brother married her when she had ILR and he came to uK after marriage through the Spouse visa and first entered on 1 -aug-2013.
Can you please help me with the answer?
