Tier 2 ICT dependent to Tier-2 general

Post by kaladin » Tue Jun 26, 2018 8:17 am

I'm on an ICT tier-2 and my wife's a dependent on my visa. We are both in the UK and my visa is valid for another year. Wife's employer is now willing to sponsor a tier-2 general visa.

1) Should my wife have to apply for the tier-2 general from the home country (India)? Not possible to switch from within the UK?

2) If she can apply only from India, does she need to be in India right until the decision is made? Or can she simply go back to India, apply for the tier-2 general, come back to the UK (on her dependent visa) and wait out the decision on the tier-2 general (while in the UK)?

1. Apply from home country. No option to switch within the UK.

2. She has to submit her passport. If visa is approved, her dependent visa is cancelled. She should wait I home country. She can apply using priority service for an extra fee.

Presumably her employer has completed the full and proper RLMT to prove she is not pre selected?

Tier 2 ICT dependent to Tier-2 general

Post by kaladin » Tue Jun 26, 2018 9:34 am

Hi there,
My wife and I are currently in the UK. I. I'm on an ICT tier 2 visa and my wife's a dependent on my visa. My wife's been working on her dependent visa and her employer has now agreed to sponsor a tier-2 general visa.

1) Should my wife have to apply for the tier-2 general only from the home country (India)? If yes, can she simply apply from India and then await her decision while in the UK?

2) The RLMT for her tier-2 general is already underway (with my wife taking the interviews with her employer in the UK). Would my wife applying for the tier-2 general from India necessitate any change to this process? I mean, would RLMT have to be taken up again?

Thanks for your responses. Yes, full and fair RLMT has been conducted.
