FLR(M) on section 2.2,2.3 and 9.1

Post by lkckachun » Sun Jul 01, 2018 11:29 pm

I have some questions regarding FLR(M) form on section 2.2,2.3,9.1 and I would like to get some help on this forum.

First of all, a bit of background of myself. I came from Hong Kong. Two years ago, I studied a Master degree in UK under Tier 4 visa and I was offered a BRP during that time. After my study, I went back to Hong Kong and got married with my wife who owns in permanent residence in UK. After that, I applied EEA family permit(6 months) and came to UK. And now, I wish to apply for a spouse visa.

Regarding section 2.2
Question: Is this the first time you have applied for a visa or extension of stay in one of the above
categories (including previous leave granted as a fiancé(e) or proposed civil partner) with your
current sponsor?

My Answer: I guess that is a yes as this is actually my first time to apply spouse visa. Or EEA family permit already counts as a visa?

Regarding section 2.3
I am not sure I am on first period or second period as I do not know EEA family permit is a entry clearance or a leave to remain.
(First period of leave to remain (following an initial period of entry clearance as a partner of a
settled person, or person who is in the UK with refugee leave or humanitarian protection, or
as a child of a person who has limited leave as the partner of settled person, or following an
initial period of entry clearance as a fiancé(e) or proposed civil partner of a settled person - 6
months).
(Second period of leave to remain (following initial grant of leave to remain as a partner of a
settled person or person who is in the UK with refugee leave or humanitarian protection, or
as a child of a person who has limited leave as the partner of a settled person).

Regarding section 9.1
Question:Have you been issued with a Biometric residence permit with a previous application for
leave?

My Answer: Yes? Since I did obtain a BRP before for my student visa. But I am not sure if student visa is an application for leave. Or it is better to provide every possible detail you can so I just tell them I did have a BRP before.

I would like to know if I answer those question well and your help is much appreciated.
Thanks

If you are married to an EU national (non British) you can't apply on Flr M. You need to apply for an EEA residence card.

Yeah, but she obtains permanent residence for UK recently so I guess it is fine.

The reason why we go for this spouse visa is because I had a job opportunity waiting for me and I have to obtain working right as soon as possible, while only spouse visa has premium service which can be done in one day. Otherwise, for residence card, it takes 6-12 weeks
