Question regarding ILR

Hello,

My initial visa for Tier 1 Entrepreneur was approved on 20th August 2014. I made application for extension on 17th August 2017 and still waiting for a response. I received a letter from the caseworker in April 2018 to provide him with some documents which were in a different format in my application. I promptly sent them but since there has been no update.

My question is, how is the 5-year route to ILR counted? I mean, since my first visa was granted in August 2014, can I apply for ILR in August 2019? Or I have to wait until the end of my 2 years extension visa? Also, I am completing my 10 years in UK in August 2019. Which would be the easiest way for me and my wife, to get ILR on 5-year rule (Entrepreneur Visa) or through 10-year rule?

5 year route to ILR is counted from the date your visa was issued.

How long has your wife been in the UK as your dependent??

Hello,

Thanks for your response. My wife got her 1st dependent visa issued in July 2015. So if we apply on 5-year route next year, is my wife eligible for ILR along with me?

No she cannot apply with you as she doesn't meet the 5 year residence requirement.

She will only qualify for ILR in July 2020, 5 years from the date her visa was issued (as the rules stand now).
