Hi, I don't know where to start with this - my son's girlfriend is from China, she has been studying in the UK and now they have graduated and are trying to work out how they can stay together. They have been together around 9 months, want to marry (although probably would have saved up first if they had the choice). Neither are in employment at the moment as they have only just finished uni but my son is looking for work. She is at home visiting her parents and on her return will be living with us but what to do when her visa runs out? I feel a bit overwhelmed by all the information online, can anyone advise? TIA

She cannot stay beyond her current visa if she is not able to meet the requirements to switch to a spouse visa if they get married.

You don't state when her current visa expires??

In order to marry in the UK, they are both required to attend a Home Office approved Registry to give 28 days notice of their intent to marry. The Registry office then informs HO, who could extend the notice period to 70 days to investigate and/or interview each of them separately before granting permission to marry.

To qualify for a spouse visa, financial evidence of at least 6 months payslips and bank statements showing £18,600pa income must be provided or £62,500 in savings held for at least 6 months.
