BC Application (NDRS JCAP) + Marriage chaos

Post by tier2genmisery » Fri Jul 06, 2018 12:55 pm

Hi

I'm about to embark on this wonderful BC application journey which apparently takes months and months.
My challenge is I don't know which path the follow.
I got my ILR 1 Aug 2017 which means I can apply for BC on 2 Aug 2018
I am planning to do a NDRS + JCAP as that seems to be the fastest way of getting a passport.
In parallel to this, I am planning to get married and/or make my fiancé dependant on me so that she can be free of Tier 2 and change jobs easily.
I don't know what is the fastest and easiest way to tackle all of this..
Here are my questions

1) If I make a NDRS JCAP application, I can travel abroad with my current passport and ILR while my application is under consideration, right? (Just need to double confirm this)

2)How do I get an NDRS JCAP appointment booked with the council (any council) before I make the application online on 2 Aug 2018?
RBKC online booking portal asks for my application reference number just to show available NDRS appointment timeslots.. I want to have the NDRS appointment on 2nd Aug as well so I have to find a way to book an appointment before my online application.. Any advice?

3)My fiancée is currently on a Tier 2 Gen work visa which is due to expire in December. She has a UK masters degree (1yr on Tier 4 then 3yrs on Tier 2) and we have been living together since almost 4 years now.
Her company won't pay for the extension of her Tier 2 and she wants to change jobs. It is nearly impossible for her to find a new Tier 2 job in her field (creative/design) so she wants to become my dependant instead.
I cannot get married during my citizenship application (as far as I know) which could take 6+ months. But since we have been co-habiting for nearly 4 years we thought she could maybe become my dependent anyway without getting married. Is that true? And if yes, would that give her right to work without sponsorship?

4)If she becomes my dependent during my BC application while I'm still on ILR, does my BC application affect her status? Does she need to do anything if I then become a BC?

5)Also, if she becomes my dependent (but without marriage or civil partnership), is that something I have to report to HO while my application is with them and under consideration?

6)In terms of ability to work without sponsorship, are BC dependants same as the ILR dependants?
I heard that BC spouse/dependants don't have the right to work or right to work for a while. Is that true?

I see people on this forum answer some really tough legal/procedural questions and I hope these ones are challenging enough. I will come back more with even tougher questions later :)

Thanks

Nothing prevents you from marrying while your citizenship application is in process!! What makes you think you can't???

Partner of ILR holder and BC are the same visa - FLR(M). Partner free to work or not, their choice.

Also, kindly post partner visa questions in the Family Immigration sub forum, link below, as it is not relevant to the British Citizenship sub forum.

The main topic is definitely BC so that's why I posted here. Sorry if that wasn't clear in the message. BC is the priority application here, marriage can come later, especially if my fiancée can become my dependant without getting married. I will split this and post the family questions in the other sub forum.

It is not impossible to get married during the BC application but on the application portal it says
You’ll be told if you need to give more information to help with your application. You should also contact UK Visas and Immigration if your situation changes (eg, you move house, get married or are arrested) during your application.

This means that a significant situation change like a marriage can frustrate and slow down my BC application and they might request more documents. I can't risk that.

There is a 28 day to 70 day notice period of intent to marry and HO has to give approval before you can get married.

So either marry before you apply or apply for an unmarried partner visa if you have rock solid evidence of living together for 2 years. This application can be made in person same day decision.

I'm scared now that you said 'rock solid evidence'
I was hoping council tax bills on both our names, shorthold assured tenancy agreements also both names and some photos would be enough..

Unfortunately not enough for an Unmarried Partner visa. HO want to see substantial evidence of cohabitation 'in a relationship akin to marriage' and there is no discretion on this as unmarried partners.
