Visa expired urgent help

Post by SA6190 » Fri Jul 13, 2018 10:50 am

I was on tier 2 visa and my visa was on tier 2 dependant visa. I got my British passport recently however we just came to know that my wife visa expired over a month ago (6 weeks). We completely forgot to extend her visa as we recently had a baby and also my wife set up her business in the UK and she has been really busy with both the baby (6 months old) and the business.

What options do we have? My wife is a Canadian national. Should she fly out of the country to apply for spouse visa ( I have sufficient income) or should she file in out of time application in London?

An out of time application will fail and she will now likely have to start her residence period again from scratch on the family visa route and not the PBS Dependent visa route.

She could try apply for FLR(FP) Partner route but they take long to process and often end in refusals.

She could leave and apply from Canada if she wishes, which will be a new 5 year (2 x 2.5 year visas) residence before she can apply for ILR.

What is the exact date of expiry as it appears on her visa??

With her Canadian passport, we are not too worried about her ILR and time it would take but we want a valid visa for her to work and stay in the UK. Her visa expired 6 June 2018.

Do you recommend she leaves the country and apply from Canada?

Do you know how long would it take on a priority service?
