Employment for T1E - ILR

Hi All

I got T1E in December 2013, so finishing 5 years in Dec 2018 and can apply for ILR 28 days before in November third week. My current leave is till Feb 2019.

I have
Job 1: One full time employee who is continuing before I get last extension in Feb 2017, she will finish 20 months by the end if October2018.

Job 2: One employee was continuing before I get last extension in Feb 2017 and left on 30 June so worked 3 Months.

Job 3: Started from January will finish 10 Months by October 2018.

All Jobs are different but total months are 20+3+10 = 33, I am pre April 2014 (Dec 2013) applicant but last extension was in Feb 2017. still pre April 2014 rules applied

Can I apply in the end of November 2018 OR should wait until third employee finishing 12 months after Dec 2018?

There have been cases here about people who have successfully used the super premium service

Hi All

I was out from UK for 133 days again will be out for 14 days totalling 147 days. I’m on Tier 1 E visa finishes in mid February 19,will be finishing 5 year on T1E in November end and finish 10 year in beginning of March. I have 10 days prior to apply on ILR-LR.

Due to personal circumstances I don’t want my passport stuck at HO if I apply on the SET (O). If I wait for ILR till February 19, I’m afraid I might have to go home again and will spent over 180 days.


On ILR -LR guidance published for HO staff it says CR is not broken if the applicant is absent from UK for 6 months or less at ANY ONE TIME.

I’ll be great full if someone can clarify what it does mean, at any one time OR in a year?

SET (O) it clearly says in any consecutive 12 months of the qualifying period.

I’ll appreciate any help

5 Year ILR limits absence to 180 days in any 12 months.
10 Year ILR is 180 days at a time and a total of 540 days in 10 years

It depends on which route you are applying for ILR, tier 1 or LR, as the rules are different.

For Tie 1 to ILR - it is no more than 180 days in ANY 12 month period.

For LR it is any single absence of no more than 180 days at ANY time.

T1E to ILR - LR need to clarify some doubts

Hi All,

My Tier 1 Entrepreneur leave (2 yeas extension) finishes on 20 Feb 2019 and completing my 10 years on 6 Mar 2019.

I have finished, five year on T1 Entrepreneur and have complied with employment creation requirement in the extension period I am eligible to apply for LR on SET (O). However, in case of Set (O) for Tier 1 Entrepreneur, usually it takes very long time period and there is no appeal right. Further, Set (O) for Tier 1 Entrepreneur there was no Premium appointments allowed neither new Super priority service is available. Therefore, I think it’s better to apply on long residency SET (LR).

I am thinking to apply for ILR -LR, 28 days before completing 10 years. However, need to clarify some doubts.

Given my current leave is expiring before I can actually finish 10 years, is it OK for apply on ILR - LR even if my existing leave does not permits me to stay 10 years?

Second, obviously I haven't finished 10 years. Should I write 9 years and 11 months or 10 years while filling in the form?

Third, I was out of country for 165 days excluding travel day/date in last one year, after March 2018. There is arrival stamp from UK immigration, however for departure dates there are no UK immigration stamps on the passport.

Finally, Do I need to provide any supporting documents for outbound travels? Do I need to provide any documentations for reasons (compelling) for traveling outside UK or just mentioning situation/reason for traveling is sufficient?

You’ll be applying before ur current leave expires and as you can apply 28 days prior to 10th year anniversary you should be safe to apply..

Whatever is the exact.. in ur case 9-11

You probably landed somewhere where your passport was stamped..

You can apply for 24hr decision.. start filling up the application.. it should put things in perspective..

Hi

I’ve applied for LR on Set O tier 1 entrepreneur new service. I want to vary on long residency now after two week. I was trying to fill in Ilr Lr form but it did not ask for me for pending application. It was asking in Set O. Can I vary on line using super priority?

Appreciate any help.
