Spouse visa to ILR: When can we apply?

Hi all,

My husband currently has FLR and will have been in the UK for 5 years on 23rd November 2018. His BRP has an expiry date of 14th December, which is more than a little confusing!

We easily meet all the requirements for ILR but it's not clear when the earliest date we can apply is. We are planning on booking an appointment at the Premium Service Centre as we did for his FLR(M). Having searched the gov.uk website, it's still not clear whether he can apply 28 days before 23rd November, 28 days after 23rd November or 28 days before 14th December!

I'd really welcome advice on this, as the official advice is so confusing. Thanks in advance!

He can apply within 28 days prior to his 5th anniversary from the date he entered the UK on his spouse settlement visa.
