Tier 2 - new 5 year visa

Hoping someone can help.

In 2014 I was granted a 5 year tier 2 visa unfortunately after 2 years I had to return to America for family reasons, I continued to work for the same company but as self employed in the US. My company now wants me to return, I do not want to return on the same visa as I won’t be able to renew it after August 2019 and due to my 2 years in the US I won’t be eligible for leave to remain.

Would my best option be for a new CoS and a new tier 2 visa?

My employer would like me to return by end of year so what is the best option for this?

When you left the UK, they would have been obliged to inform HO as part of their sponsorship duties and your visa would have been curtailed,/cancelled.

You need to check with them.

Presumably you have not been paid in the UK since leaving.

Your sponsor will also need to go through the whole process of RLMT (if non shortage), to get a RCoS and prove you have not been pre selected.

Getting RCoS approval has been difficult for many the last few months for those with lower points, some waiting 8 months to get approval after sponsor submitting RCoS for 8 months in a row and facing rejection/refusal.
